GENERAL TERMS OF USE OF THE NEG.BG WEBSITE (updated July 2022)

I. GENERAL PROVISIONS

1.1. These General Terms and Conditions shall govern the relationship between NEG.BG, UIC 201420169,with registered seat and address of management at 135, G. S. Rakovski Str., entrance 2, floor 1, Sredets District, 1000 Sofia, Bulgaria (hereinafter referred to as “NEG.BG”) and the user (User) of the website of neg.bg (hereinafter referred to as the “Website”).

1.2. By using the resources of the Website, the User declares that he is familiar with these General Terms and Conditions, accepts them, and shall comply with them.

II. DESCRIPTION OF THE WEBSITE RESOURCES

2.1. The resources that the Website offers are:

  • information about the communication platform managed by NEG.BG – BG-Mamma, history, and statistics about the Company and the product;
  • examples of successful advertising campaigns;
  • publications related to NEG.BG and the industry;
  • news related to NEG.BG;
  • advertising rates of NEG.BG, special offers to advertisers and general conditions for advertising;
  • information about job vacancies;
  • links to websites maintained by NEG.BG, supporting the channels of NEG.BG in the social networks, as well as other external links;
  • contact form for the User to contact the Management of NEG.BG, the advertising department or to ask the administrators of the communication platform – BG-Mamma.

2.2. The User shall have access to the materials uploaded to the Website.

2.3. The technology and design of the Website shall be subject to change without prior notice.

III. INTELLECTUAL PROPERTY RIGHTS

3.1. All intellectual property rights regarding the information resources and content of the Website shall be exercised by NEG.BG. They shall be protected by the Copyright Act and related rights, and any use of the contents of the Website, without the prior consent of NEG.BG shall be regarded as a violation of the law, which may result in civil, administrative, and/or criminal liability. The Website is protected by copyright and related rights and contains other similar objects of copyright protection.

3.2. The Website contains information, materials, features, and other content that constitute copyrighted and related rights and contains such objects as trade names, logos, trademarks, product and service names, and other similar objects of copyright protection.

3.3. In case of copying or reproduction of information beyond the admissible, as well as in case of any other violation of the intellectual property rights over the resources of NEG.BG, the latter shall have the right to claim compensation for direct and indirect damages suffered in full.

3.4. The use of the Website or protected objects under the previous articles, in violation of the provisions of the General Terms and Conditions, in addition to violating the agreement between the User and NEG.BG may also constitute a violation of rights on objects that are the subject of the intellectual and/or industrial property of a third party, as well as other legally protected rights and legitimate interests of NEG.BG and/or third parties. For any violation under this article, the relevant User shall assume full liability – civil, administrative, and/or criminal, and the payment of compensation imposed by a competent authority to the affected persons.

3.5. NEG.BG shall have the right to compensation for all damages, expenses, and claims of third parties that are a consequence of a violation of these General Terms and Conditions and/or unregulated use of the services on the Website.

IV. LIMITATION OF LIABILITY

4.1. NEG.BG shall take the necessary measures to keep the contents of the Website up-to-date, but shall not be responsible for the actual up-to-dateness of the same. In this regard, NEG.BG shall not be responsible for damages, including direct and/or indirect damages, including lost profits that a User of the Website may suffer under any circumstances in relation to the contents published on the Website and the access to the same. By using the Website, the User shall assume all risks associated therewith, including any risk to the User’s end devices, software, and/or data.

4.2. To the extent that the content of the Website contains links to external content, the User shall be aware of the fact that NEG.BG has no control over the same and shall not be responsible for the consequences of opening links redirecting the User to an external website.

4.3. NEG.BG shall not be responsible for the subjective perceptions and/or interpretation of the accuracy, completeness, and usefulness of the information resources on the Website.

4.4. NEG.BG shall not be responsible for malicious acts by third parties, to which the User could become subject when using the Website. The User shall use the Website at its own risk.

4.5. NEG.BG shall not be responsible for any losses, direct, indirect, and/or consequential damages and lost profits, as a result of and/or in connection with the use of the Website and/or the temporary inability to access/use the Website.

V. USE OF THE WEBSITE

5.1. TheUser of the website shall accept and comply with these General Terms and Conditions. With each use of services and resources of the Website, including opening an Internet page from the Website, the User declares that he is familiar with these General Terms and Conditions and agrees to them and shall comply with them.

5.2. TheUser should use the Website in good faith, including not taking malicious actions that may affect the accessibility of the content to third parties and/or the use of the Website in general.

5.3. The use of the Website shall be carried out without the need for prior registration by the User.

5.4. The use of the Website shall be free of charge and available 24 hours a day, 7 days a week (24×7).

5.5. Any use of the contents of the Website, including recording, copying, publication, reproduction, distribution, broadcast, transmission, and/or retransmission over an electronic communication network, publication on the Internet, public display, processing, and/or use in any other way, except for those specified in these General Terms and Conditions, shall be allowed only after the express permission of NEG.BG.

VI. OTHERS

6.1. NEG.BG shall reserve the right to amend these General Terms and Conditions at any time. The current General Terms of Use of the Website shall be published on the same.

6.2. The provisions of the current legislation of the Republic of Bulgaria shall apply to all matters not settled by these General Terms and Conditions.

This Privacy Notice regarding the processing of personal data by “NEG.BG” AD provides information on the categories of personal data that the Company collects, stores, and processes; the purposes of collection, storing, and processing; the terms of their storage and the possibilities of exercising the rights of the data subjects in relation to their personal data.

The information presented below shall refer to the personal data of Users of the website of neg.bg (hereinafter referred to as the “Website”) or the use of services through this Website and shall not apply to other websites and/or services that NEG.BG AD (the Administrator) does not own or control.

GROUNDS FOR COLLECTION, STORAGE AND PERSONAL DATA PROCESSING

NEG.BG collects and processes personal data in connection with the use of the Website – neg.bg based on the following grounds:
• Express consent obtained when using the contact form;
• Compliance with a legal obligation that applies to the Administrator;
• For the purposes of the legitimate interests of the Administrator or a third party;

PURPOSES AND PRINCIPLES OF COLLECTION, STORAGE AND PROCESSING OF PERSONAL DATA

The Administrator shall collect and process the personal data that the Users provide for the purposes of the functioning of the Website – neg.bg, observing the following principles in the processing of personal data:
• lawfulness, fairness, and transparency;
• purpose limitation;
• relevance with the purposes of processing and minimization of the data collected;
• ensuring the data are accurate and up-to-date;
• storage limitation in view of achieving the purposes;
• integrity and confidentiality of the processing and ensuring an appropriate level of security of the personal data.

The Administrator shall process and store personal data in order to protect the following legitimate interests:
• information security

• fulfilment of obligations to the Ministry of Interior and other state and municipal bodies.

NEG.BG, in its capacity as a Personal Data Administrator, shall process personal data as follows:

Personal data obtained from the contact form:

When an inquiry is received from a person through the contact form on the Website, the contact details (e-mail) provided by him/her shall be used to contact him/her and provide the information and/or assistance he/she needs.
In order to guarantee the information security of the Website, information about the IP address of the person shall be also collected.

Via the contact form, the visitors of neg.bg can contact:

  • the management of NEG.BG AD
  • the advertising department of NEG.BG AD
  • the administrators of the communication platform supported by NEG.BG – BG-Mamma (bg-mamma.com).

The collected personal data (e-mail address and IP address), together with the text of the message, shall be sent by e-mail to the selected recipients and not stored in a database. Messages sent through the contact form shall be used only to respond to inquiries.

IMPORTANT!
When using the contact form, you do not need to provide personal data (your full name). You can use the name of the company you represent and/or specify your username in BG-Mamma.

Personal data obtained through the contact form shall be stored for a period of up to 5 (five) years from receipt of the relevant request.

Personal data received from the Notice form under Art. 16 of the Digital Services Act:

Upon receipt of a Notice under Art. 16 of the Digital Services Act through the specific form available on the Website, the contact data provided by the person using the Website (full name and e-mail) shall be used by NEG.BG to fulfil its obligations under Art. 16 and Art. 17 of the Digital Services Act.

In order to ensure the information security of the Website, information about the IP address of the person shall be also collected.

IMPORTANT!
The personal data received through the Notice Form under Art. 16 of the Digital Services Act, shall be stored for a period of up to 5 (five) years from receipt of the relevant Notice.

DATA COLLECTION METHOD

The Administrator shall only process and use data that the Users of the Website have provided voluntarily, and there shall be no mechanism for verifying the authenticity of the provided personal data. Each User shall bear full personal responsibility not to provide data to third parties in violation of their rights to the protection of personal data.

SECURITY MEASURES

NEG.BG shall implement a wide range of technical and organizational measures to protect personal data against loss, illegal access, or other forms of illegal processing. Personal data shall only be available to employees who need access to perform their duties in connection with the provision of the services.
All company employees having access to personal data shall be trained and authorized accordingly.

The Administrator shall not provide the collected personal data to third parties without a legal or contractual basis. The Administrator shall not sell or distribute collected personal data in any other way.

MINORS AND UNDERAGE PERSONS

The Website may only be used by persons over the age of 14.

If you believe that a person under the age of 14 has mistakenly or accidentally submitted personal data that the Administrator has collected, stored, and processed, please notify the Administrator using the following e-mail: [email protected].
If the Administrator receives information for the collection of personal data from a person under the age of 14, this data shall be immediately deleted, unless there is a legal obligation to store this data.

RIGHTS RELATED TO THE COLLECTION, STORAGE AND PROCESSING OF PERSONAL DATA

As a data subject, the User has the right:

  • to receive information about whether the Administrator stores and processes the personal data of the User;
  • to request a copy of the User’s personal data;
  • to verify the accuracy of the stored information;
  • to request correction or update of this data;
  • to object to the processing of personal data if there are grounds for doing so;
  • to request the restriction of the processing of the User’s personal data, if applicable, for example: to challenge the accuracy of the personal data, for a period that allows the accuracy of the personal data to be verified; the processing is illegal, but the User does not want its personal data to be deleted, but only to restrict the use of personal data; the Administrator no longer needs the personal data for the purposes of processing, but the User requires them to establish, exercise or defend its legal claims; the User has objected to the processing pending for a verification whether the Administrator’s legal grounds prevail over its personal interests;
  • to request that its personal data be deleted if any of the following grounds apply: the personal data are no longer necessary for the purposes for which they were collected; when the User has objected to the processing; when the processing is unlawful; when the data is processed on the grounds of consent and the User has withdrawn this consent; when personal data should be deleted in order to comply with a legal obligation under EU law or the law of a Member State that applies to the Administrator.
    Deletion of personal data can be refused for the following reasons: exercising the right to freedom of expression and the right to information; complying with a legal obligation of the Administrator or for the performance of a task of public interest, or in the exercise of official powers that have been granted to the Administrator; for reasons of public interest in the field of public health; for the establishment, exercise or defence of legal claims.

In order for us to be able to provide you with full assistance, please provide us with accurate information about yourself and specify your request. In exercising your rights, we may request additional information to establish your identity.

Please note that when the requests are clearly unfounded or excessive, in particular, due to their repetition, the Administrator has the right:

1. to impose a fee, taking into account the administrative costs of providing the information or communication or taking the requested action, or

2. to refuse to take action on the request.

The deadline for consideration and implementation of the admissible requests related to the rights of the persons in terms of personal data protection is 30 days from the receipt of the request. If necessary, this period can be extended by two months, taking into account the complexity and the number of requests.
