Guidelines for the validity of the Notices under Article 16 of the Digital Services Act
Validly submitted Notice under Article 16 of the Digital Services Act shall be reviewed by NEG.BG if the Notice contains all the elements specified below:
1. A sufficiently reasonable explanation of the reasons why you claim that any information constitutes illegal content;
2. Clear indication of the exact electronic location of the information (the exact URL) and additional information enabling the identification of the illegal content, adapted to the type of content, if necessary;
3. Your full name and e-mail address;
4. A statement on your behalf that you affirm your good faith belief that the information and statements contained in the Notice are accurate and complete.
5. Consent to the processing of your personal data for the purposes of submitting the Notice.
Invalidly submitted Notice under Article 16 of the Digital Services Act shall be deemed Notices that:
- do not meet any of the above mandatory elements (lacks sufficient justification, and/or does not clearly state the exact location of the information, and/or does not state names, and/or does not state a valid e-mail address, and/or a Declaration has not been provided by the submitter of the Notice, and/or the necessary consents for the processing of personal data have not been given);
- contain false names (e.g. title/character name, nickname, made-up word/phrase, etc.)
- contain an invalid e-mail address;
- are insufficiently substantiated or that are not in substance (do not apply to information that is allegedly illegal content);
- indicate information that does not exist on the BG-Mamma platform at the time of submission of the Notice.
Notices under Article 16 of the Digital Services Act that do not meet the conditions stated above, shall not be reviewed by NEG.BG, and, if there is an opportunity, NEG.BG shall inform the sender of the Notice about the refusal to review the same.
